These Terms and Conditions (“Agreement”) govern the provision of coffee machine repair services (“Services”) provided by Pride Coffee Tech (“we”, “us”, or “our”) to customers (“you” or “your”). By requesting or receiving services from us, you agree to these Terms and Conditions.
1. Service Provision
We provide professional repair and maintenance services for coffee machines. Our technicians will assess the machine, diagnose the issue, and provide you with an estimate for the necessary repairs before proceeding. All repairs will be conducted in accordance with standard mechanical repair practices.
2. Call Out and Travel Fees
- We charge a standard call-out fee for all service requests.
- If the location of your coffee machine is more than 30km from our office located at 338 Koeberg Road, Milnerton, Cape Town, 7441, a surcharge will apply based on the additional distance.
3. Cancellation and Return of Machines
- If you wish to cancel a service request after your coffee machine has been received by us, we will return the machine in the condition it was delivered, provided no repair work has been started.
- If payment for work already completed is not made, we reserve the right to remove parts from the machine to recover the cost of service rendered. Any parts removed may be sold to recover our costs.
4. Data Privacy and Compliance
While we do not actively collect personal data for the repair process, we may collect contact details such as your name, email, and phone number for communication purposes. Any data collected will be handled in compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR) in the European Union, the Protection of Personal Information Act (POPIA) in South Africa, and other relevant laws.
- We do not share or sell your personal data to third parties without your consent unless required by law.
- You have the right to access, update, or request deletion of your personal information at any time.
5. Payment Terms
- Payment is due upon completion of the repair services. We accept the following payment methods: Card, Cash, and EFT (Electronic Funds Transfer).
- If payment is not made within [insert time period], we may charge interest on overdue amounts in accordance with applicable laws.
- In the event of non-payment, we reserve the right to retain the coffee machine until payment is received.
6. Warranty and Liability
- We offer a three-month warranty on all mechanical parts that we repair or replace. This warranty does not apply to any electrical components, for which no warranty is provided.
- Our liability for any loss, damage, or injury arising from the repair work shall be limited to the cost of the services provided. We are not liable for any indirect, incidental, or consequential damages.
7. Geographical Restrictions
- Our services are available within the Western Cape region. For service requests outside of the region, additional charges and conditions may apply.
8. Force Majeure
We are not liable for any delays or failure to perform our services due to causes beyond our control, including but not limited to natural disasters, pandemics, strikes, or government restrictions.
9. Dispute Resolution
In the event of a dispute arising from these Terms and Conditions, both parties agree to attempt to resolve the matter amicably through mediation. If mediation fails, the dispute will be resolved in the appropriate court in the Western Cape, South Africa.
10. Changes to Terms and Conditions
We reserve the right to update these Terms and Conditions at any time. Any changes will be communicated to you, and the updated version will be posted on our website. The changes will be effective immediately upon posting.
